But the FDA's ambit doesn't include considering privacy concerns, does it, just whether or not a particular product is health-endangering or not?

Safety and efficacy. The FDA is charged with determining the safety and efficacy of medicines, drugs, and 'surgical devices'. I honestly couldn't think of what other Federal agency would be asked to 'approve' such an item, though - maybe the FCC. I emailed the FDA about it, and then I emailed both my Senators and my Congressman. grrrrrr.
